NO CHEATING/FRAUD FOR MBBS ADMISSION ACCEPTABLE IN MEDICAL COLLEGES -SUPREME COURT PASS HARSH ORDER FOR A PETITION SEEKING RELIEF

THE KANNUR MEDICAL COLLEGE under Kerala University of Health Sciences was denied persmission to take admission of MBBS students in sesssion 2018-19 by The Admission Supervisory Committee for  professional colleges in Kerala as this college doesnot comply with the order of committee to refund excessive fees taken from students in year 2016-17.The Committee found that the college admitted students as per their choice and extracted hugh money from them for admission in MBBS Course.

                The college went to kerala high court against it which rejected college plea and order college to comply with Committee order of refunding students excessive money taken by them.Against which the college moved to supreme Court.The highest Court realised bad intention of college not to return students the excessive money charged but to get relief from the court and passed such an order to return double the amount of excessive money taken from every students,not to admit students as per their will and charge as they want but to follow the guidelines of Admission supervisory Committee and provide 1 crore to Kerala CM Relief Fund as a help to flood victims soon. 

                     This is the usual pattern of modus operandi of admitting students out of merit in many private medical college taking hugh capitation fee as exposed by few Media Sting operations too.First these colleges invite high scoring students to block their seats by paying them bribe in lacs and not keeping their certificates as required sothat when they get admitted in good medical colleges ,these seats are back to such Medical Colleges in mopup round.Such seats they sell either to NEET less ranking students against capitation fee in lakhs or as NRI students who simply sat in exam but secured very low rank.The college rank is so low in Medical education grading that many waiting in NEET ranking or admitted students never complain this to State or Central authority or MCI.Even if exposed by MCI or State or found deficient in MCI inspection ,than such Colleges move to their High Court which was usually directing to admit students and re inspection of MCI which being tainted closed such files of Black earning of medical colleges on the pretext of such judicial orders and so corruption was going on and Colleges were earning hundred crores without any fear of any action.

                         But as Supreme Court brough NEET to close this thousand crores black money industry of Pvt medical Colleges which were opened as mushroom in last few years in India to earn thousand crores by investing few crores in 1-2 years by admitting students taking a bribe of 1-4 crores for UG or PG MBBS /MD /MS courses.Supreme court was too strict on many High Courts who gave orders so that these colleges can run their black industry uninterrupted and MCI as being very strict now as it's open corruption was exposed in media and before parliamentary Committee and being replace by NMC soon moved to Supreme Court in few cases as suitable to them against orders of High Court allowing Medical colleges to admit students even if MCI finds a lot of deficiencies or their excessive fee charges or admitting wrong students against capitation fee in lakhs as in this case complained by students.                        

                           The Supreme court, while disposing an SLP filed by Kannur Medical College, directed the College to pay an amount of Rupees One Crore from the cost imposed by the Court to the Chief Minister’s Flood Relief Fund, Kerala by 20th septmeber.It also directed the college to also deposit the sum of Rs.10,00,000/- (Rupees Ten Lakhs) with the Supreme Court Advocates-on-Record Welfare Trust and Rs.1,00,000/- (Rupees One Lakh) with the Supreme Court Bar Association.

              The college was also directed to return the double of the amount than the fees at deposited by each one of 150 students with college, by 4th September, 2018. Other terms in the order are as follows It allows the college to admit students saying that the order of ASC for withdrawal of the affiliation shall not be acted upon in case this order of supreme court is complied with.

            It ordered  that Kannur Medical College, shall be permitted to participate in the mop-up round, which is going to take place on 4th and 5th of September, 2018, before the Controller of Entrance Examination, Kerala, and only those students who opt for college shall be allotted and no other. The fees fixed by the ASC shall only be realised by the college from the students who opt for the college in question for the year 2018-19 onwards. The college shall not admit even a single student for the year 2018-19, other than the one allotted by the Controller of Examination in the counselling that is to be held on 4th and 5th of September, 2018.

               In case of violation, entire order shall be withdrawn. It is also undertaken that in future the college shall not collect the fees in any name more than one year’s fees as prescribed under the Kerala Medical Education (Regulation and Control of Admission to Private Medical Educational Institutions) Act, 2017 and by ASC. Directing the college to return the original documents to the students, the bench disposed the SLP and observing that in case of non-compliance of the terms agreed upon, the order will be withdrawn by this Court.

                    Such a wider order to prevent existing corruption at different levels by Medical Colleges for admission of MBBS ,PG or PG SS seats is an eyeopener and it will check this notorious black industry of crores where after managing local,state and University administrators by paying bribe by handling MCI and Courts favourable Medical Colleges were earning crores which will stop now as either MCI finds deficiency of if a left out desrving NEET cleared student or admitted student complain of any corruption in ad mission in a Medical College,Supreme Court will heavly fine the College if approached for relief on wrong grounds.

                              How as a doctor or Medical student see such path deciding order of highest court of our Country to clean the tained medical education?
