 With the introduction of Discriminatory and Unethical flag ship project of CM Mamta Banerjee for alluring public and media in name of SEWA ,"West Bengal Clinical Establishment Act " which discriminate Doctors and treatment at Private & Government Doctors and treatment with treatment and submit Doctors and Hospital for rigorous punishment including jail on a mere complain by any patient unsatisfied after trial by either Bureaucrats or retired Judges within 6 months where Doctors and hospital cant keep their points,reports seem to be flowing in that the private hospitals in the state are fearing to accept emergency cases, fearing that a patient’s death might lead to them facing the wrath of the government. This in turn as caused tremendous burden on states government hospitals, most of which are already overburdened with queues of patients.
           Media across West Bengal and National Media  reveals, since the enactment of ACT, that SSKM Hospital, the only super-specialty hospital government hospital in Bengal has been overloaded with critical care patients who are being transferred by the private hospitals in recent days citing various reasons. The inflow of critical patients has gone up as high as 30%. As per the past few months data, the other state run medical colleges including the Calcutta Medical College and Hospital and the NRS Medical College and Hospital has also got high rise of emergency patients.The basic facilities in these Hospitals lack so much that many departments donot work round the clock in scarcity of equipments,technicians and doctors beside there is an issue of redtapism,lack of workculture and mindset of Government setup so Peoples across the state and particularly affluent and middle class patients are very much unsatisfied and questioning the tough decision a political gimmick of Chief Minister .
          Two private hospitals in Calcutta have been told by their majority investors that if the Bengal government takes an "antagonistic" stand towards private health care, they will either pull out or put on hold all expansion plans. "Just like the trade unionism of the previous government had chased out industry from Bengal, the present government's hostility could force some private nursing homes to exit Bengal," said a hospital official as tough stand of Mamta Banerjee  on Tata nano factory pulled out TATA and many Industry out of west Bengal and still many donot want to come to West Bengal as now she is ruling.
   Senior doctors at three private hospitals have told officials they will not admit or operate on critically ill patients. "Who will risk beatings by goons or wrongful arrest for trying to save a life?" a doctor said. Nursing homes all over West Bengal are refusing to treat critical patients. Some are saying their critical care equipment are malfunctioning. "If any patient dies in the ICU, the nursing home would be ransacked by a mob or the doctors would face arrest. The only way out is to refer critical patients to government health centres," said a nursing home official.
          Doctors' body IMA (Indian Medical Association) expressed the same concern. "How can only private doctors be brought under a commission and government hospital doctors kept out of its purview?" asked K.K. Aggarwal, its national president.the new bill was not a replacement for the consumer protection act. "So, a doctor or a hospital found guilty in one case may be fined twice - once by the consumer forum and again by the commission," said Aggarwal. "These points need to be debated."
       Kunal Saha, the doctor whose crusade against negligent doctors had led to a landmark compensation case,now president of People for Better Treatment (PBT), a voluntary organisation fighting for patients' rights, said in a statement: "Do poor patients who suffer and die in government hospitals have no worth of their lives?"He added: "(The Bengal) bill has specifically excluded all government doctors and hospitals from any pro-patient provisions. Ironically, more than 70 per cent of Bengal patients, mostly from the poor socio-economic background, are compelled to attend government hospitals due to high treatment cost in private hospitals. The rate of medical negligence or ethical malpractice is perhaps more in government hospitals."
                    Will witty Political Leaders like Mamta Banerjee who do all wrong doings to win elections change their regular habit of targetting Doctors and Hospitals to gain Political scores by raising untrue assurance to Public making headlines in Media by raising issue of High price or un curative medical treatment by Doctors and hospitals ? Government still allocate so less fund  in Public health leading to unavailability of adequate doctors,nurse,hospitals,equipments of Diagnosis and facilities of treatment and medicines so People are bound to move to private sectors for good diagnosis and perfect prompt satisfactory treatment taking good medicines after an accurate diagnosis.
        If Government is so much adamant against these then why our Parliament or Assembly donot pass a bill to prevent Doctors and Hospitals run in private or close all foreign and Pharma companies to sell medicines,medical gadgets or prostheses with a brand name except a Generic name ? but till that atleast leave blaming or softly targeting Doctors and Hospitals for making Public and Media fool with such discriminatory and Unethical Laws  by hiding your inability to do any good to public.
